The purpose of introducing IR35 is to tax the disguised employment, prevailing in the UK economy. Earlier, it was believed that the system was introduced because some contractors were avoiding paying off their taxes in the name of hidden income. In this arrangement, contractors and freelancers providing their services through a limited company or a partnership need to pay tax and national insurance contributions.
The system also brings greater transparency into the system. The IR35 legislation effectively seeks to determine the relationship between you and your end client. For example, if you sign a contract with an agency and the agency again signs c contract with the end user. This simply means that there is no contract between you and the end user. To eliminate this gap, the government has started ir35 that brings greater information and evenness into the working system. According to new rules, the government tries to sign a hypothetical contract between you and your end user and establish a relationship.
History of Ir35 Tax:
IR35 was introduced on 6th April 2000 by the Inland Revenue. The legislation was intended to bring into line the tax and National Insurance paid by contractors operating through personal service companies with the levels paid by permanent employees.
The system includes services where a worker performs services to a client through an intermediary such as a personal service company.
Need for IR35 Insurance
Due to increasing transparency into the taxation system, insurance has been introduced to tackle the losses caused due to this new system called IR35. It further safeguards the losses due to several factors including Control, Right to substitute worker, Provision of equipment, Financial risk, Basis of payment, Opportunity to profit from sound management, Whether part and parcel of the organization, Right of dismissal, Employee benefits, Length of engagement, Personal factors, and Intention of the parties.
